Terms & Conditions

1. Who We Are
Welcome to looksmartuk.co.uk ("the Site"), operated by [Sarah & Simon Smart] ("we", "us", "our"). We are a UK-based business handcrafting and selling luxury artificial wreaths, hanging baskets, decorative planters, and floral arrangements.

These Terms and Conditions apply to all orders placed through looksmartuk.co.uk. Separate terms apply to bespoke commissions — see our Custom Orders Terms & Conditions, which take precedence for personalised items. Our Privacy Policy and Cookie Policy also form part of these Terms by reference.

2. Acceptance of These Terms
By placing an order with us, you confirm that you accept these Terms and Conditions and agree to be bound by them. If you do not agree, please do not place an order.
We reserve the right to update these Terms at any time. Changes will not affect orders already placed. The version in force at the time you place an order is the version that applies to that order.

3. Eligibility
By placing an order, you confirm that:

  • You are at least 18 years old, or are placing an order with the consent of a parent or guardian;

  • You are legally capable of entering into a binding contract; and

  • The information you provide during the order process is accurate and complete.
     

4. Products
All products are handmade using artificial (faux) floral materials. Because each piece is handcrafted, there may be minor variations between the product shown in photographs and the item you receive — for example, in exact flower placement, foliage density, or ribbon positioning. These variations are a natural feature of handmade goods and are not considered defects.
We make reasonable efforts to display product colours accurately, but colours may appear slightly different depending on your device screen.
Product availability is not guaranteed until an order is confirmed. If an item becomes unavailable after you order it, see Section 6 (Order Acceptance and Cancellation).

5. Prices and Payment

  • All prices are listed in GBP (£) and include VAT where applicable.

  • We reserve the right to change prices at any time, but changes will not affect orders already confirmed.

  • Payment is taken at the time of order via the payment methods displayed at checkout.

  • We use third-party payment processors and do not store your full card details.
     

6. Order Acceptance and Cancellation by Us
Your order represents an offer to purchase. We accept that offer when we dispatch your item(s) or send confirmation of dispatch. Until that point, we may decline or cancel an order — for example, if an item is out of stock, if there has been a pricing error, or if we suspect fraudulent activity. If we cancel an order you have paid for, you will receive a full refund.

7. Delivery

  1. We offer free UK mainland next working day delivery on all orders, as stated on our Site.

  2. Delivery timeframes are estimates and not guaranteed. We are not liable for delays caused by the courier or events outside our reasonable control.

  3. Please ensure your delivery address and contact details are correct at checkout — we are not responsible for non-delivery caused by incorrect address information provided by you.

  4. Risk in the goods passes to you once the item is delivered to the address provided.

8. Your Right to Cancel and Returns

As a consumer shopping online in the UK, you have a legal right to cancel your order under the Consumer Contracts Regulations 2013, generally within 14 days of receiving your goods, without giving a reason. To exercise this right, please contact us or use the returns form on our Site.

  1. Items must be returned unused, in their original condition and packaging where possible.

  2. You are responsible for return postage costs unless the item is faulty or not as described.

  3. Refunds will be processed within 14 days of us receiving the returned item, using the original payment method.

Bespoke or personalised items made to your specification are exempt from the standard right to cancel, in accordance with the Consumer Contracts Regulations 2013. Please refer to our Custom Orders Terms & Conditions for details specific to made-to-order pieces.

9. Faulty or Damaged Items
If your item arrives faulty, damaged, or not as described, please contact us within a reasonable time of receipt, along with photographs where possible. Under the Consumer Rights Act 2015, you are entitled to a repair, replacement, or refund depending on the circumstances. This does not affect your other statutory rights.

10. Intellectual Property
All content on this Site — including text, images, logos, and product designs — is owned by us or licensed to us, and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use our content or product designs for commercial purposes without our prior written consent.

11. Limitation of Liability
To the fullest extent permitted by law:

  1. We are not liable for any indirect or consequential loss arising from your use of the Site or purchase of our products;

  2. Our total liability to you for any claim arising from an order is limited to the price paid for that order;

  3. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability which cannot be excluded or limited under UK law.


12. Product Care and Safety
Our products are decorative items intended for home use and are not suitable as children's toys. Please keep small decorative components away from young children and pets. Care instructions, where relevant, are provided on individual product pages or within our blog.

13. Privacy and Cookies
Our collection and use of your personal data is set out in our Privacy Policy. Our use of cookies is set out in our Cookie Policy. Both are incorporated into these Terms by reference.

14. Events Outside Our Control
We will not be liable for any failure or delay in performing our obligations where that failure or delay results from events outside our reasonable control, including but not limited to courier delays, adverse weather, supply shortages, or other circumstances beyond our control.

15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer resident elsewhere in the UK, you may bring proceedings in your local courts.
